To me it just demonstrates how desperate ASX are to try and win the ISX vs ASX Federal Court trial. It looks like ASX are willing to take exceptional risks at potential large cost, both financially and to their reputation to try and win. I know the ISX lawyers would not advise ISX to release the below announcement if they weren't confident of being able to prove a privacy breach.
