    I don't think you get what I'm suggesting.

    Visa are a card scheme - banks join Visa's card scheme and become a member. Part of becoming/remaining a member is to follow the rules of the scheme. Visa set the rules. If member banks don't follow the scheme rules, they risk penalties or at worst being removes.
