I can't see this as particularly bad news. VIVUS were dodgy all along. Apparently there is some dispute as to a $1m payment that VIVUS may still have to pay ACR and ACR may have legal recourse. VIVUS shares were down 1%. According to another article ACR wanted a better deal as part of the arbitration - so now they may have the opportunity to negotiate that better deal, with a better partner.
