On this forum I really don't want to get into further discussion regarding legal and regulatory matters. I will leave that to lawyers and others who are licensed to do so. But in my opinion the error in the heading (not the following text) leads to a situation that is not quite as simple as you have posed. I won't elaborate.
I will leave it to VMS and CHN to figure out (after they take proper advice, I suggest) whether there is something they (or either of them) should do.
