    Whether the company keeps going is entirely up to the administrator.

    I used to do a lot of insolvency work I've never known an action based on mis-management. If you can show that management have been fraudulent, or have deliberately mislead people (creditors or shareholders) then you may have a case, but it would be expensive. But even when, in cases of blatant fraud, we could get the DPP involved we never got anywhere.

    Without meaning to sound blameworthy, I don't think shareholders can sue for mis-management because it is shareholders who have appointed the board, so if they are no good then some of the blame comes back to shareholders.

    FWIW from reading the announcements I think CCU management has been a lot more open and honest with their statements than many other companies out there. They've even got production up to nameplate. Just the POS won't help. Sure, they've made mistakes, but everyone does that. Crystal balls just aren't all they're cracked up to be!
