"The purpose of the DOCA is to provide a fund which will enable a distribution to the creditors of the
Group, facilitating a cleansing of their respective balance sheets, and allowing the Group to realise its
business as a going concern, free of encumbrances to the DOCA Proponent who will continue to
trade the business of Nuheara moving forward."
and the last point,
"The DOCA Proponent will continue to fund the Group’s business through to the completion of the
proposed business sale and purchase agreement."
Early attempts by Azure at sale could not be concluded without a supply agreement from Realtek. The share holders committee, now the DOCA proponents, wish to sell up the assets for $500G and pay that to Realtek instead of the $2.5M. Realtek have so far refused to accept this offer. On the 25/2/25 the DOCA will be offered during the final creditors meeting, the only alternative being liquidation and creditors receiving nil. There is no indication as yet where retail shareholders stand. There are also substantial fees to be paid to KPMG etc so input of additional funding must be anticipated.
Finer details of the DOCA may be made available after the meeting if approved.
