My take on this is very different than all of what you are discussing above and if you really want to know the angle I would take if I had the money to pursue was to go to the takeover panel (TOV). And look to prove an association between certain parties that, if proven their association owned more than 20% of the shares in the company, then one of two options could be pursued. Have the TOV escrow any shares provided a party and returned. Or the associated parties make a takeover offer.
The link is three entities BoD, FS and the blocking votes that were just pulled. IMHO only and only the musings of simple minded retail investor.
