Agree. Drinking out of a boot or celebrating a victory in a battle is not a war crime.
HOWEVER...................Shooting 6 unarmed captured afghans in cold blood because you can is a war crime. We executed japanese and germans for doing this in WW2. William Calley was charged for his actions in Vietnam.
The fact that 23 witnesses are testifying against him looks to have him some trouble. Being a victoria cross winner on one hand and an alleged wife beater and war criminal on the other.
