Makes no difference to my theory. Unless every single one of JD's shares were held under OPES then under the takeover agreement he should have signed over the remainder to FAS. Where is the substantial shareholder statement indicating that this has occured?
This smells really bad and as ASIC investigations typically take a few years to complete I would not be surprised at all to see some director's names on the chopping block in a couple of years...
