Eddie Obeid appeal: Disgraced former Labor powerbroker wants sentence overturned
DISGRACED Labor powerbroker Eddie Obeid is demanding his jail sentence be overturned, claiming otherwise it will set off a wave of criminal prosecutions for pol...iticians.
Obeid claims it has set a dangerous legal precedent that will see MPs hauled before the courts to answer criminal charges when they should instead be dealt with by the Parliament’s disciplinary procedures.
The ex-Labor politician was sentenced to a minimum of three and maximum of five years in jail after a jury found him guilty of committing wilful misconduct in public office relating to charges he lobbied a senior maritime official over cafe leases owned by his family at Circular Quay in 2007.
But Obeid, 73, who is the first MP to be convicted of a misconduct charge, said his case created a legal precedent where the definition of “misconduct” is now too broad.

Obeid’s claims were contained in his appeal submissions prepared by his lawyers Guy Reynolds SC and Abbas Soukie, which were filed in the NSW Court of Criminal Appeal on March 8. The argument is one of 13 grounds in Obeid’s appeal where he is seeking to have his conviction overturned and claims his sentence was excessive.
A key element to Obeid’s appeal are the rules that govern pecuniary interest disclosures by state politicians allowed for under the NSW Constitution.
According to Obeid’s submissions, they stipulate that any breach is to be dealt with by Parliament’s disciplinary mechanisms and not through criminal or civil action in the courts.
The rules, set out in the Constitution (Disclosures by Members) Regulation 1983, were not used in Obeid’s trial in the Supreme Court by another set of lawyers who acted for him.
But they will now form a key point in his appeal, with his lawyers arguing that Obeid’s case has set a legal precedent that “infringes the dignity and autonomy of Parliament ... This amounts to the courts saying that they know better than the Parliament what are the appropriate disclosure standards to be observed by MPs in their functions”.
Obeid also claims he was not obligated to declare an interest in the cafes. According to Obeid’s submission, NSW Parliament regulations say he only had to declare a personal interest, which he claims didn’t exist because the cafes belonged to his family members.
OBEID’S SON CHARGED OVER ICAC HEARING
THE son of Eddie Obeid will “strenuously defend” criminal charges for allegedly giving false evidence to the state’s corruption watchdog.

Moses Obeid’s matter appeared in the Downing Centre Local Court on Tuesday after he was charged with giving false or misleading evidence before the Independent Commission Against Corruption.
The charges were laid over evidence Obeid gave during ICAC’s investigation into Operation Indus. This centred on allegations former Labor minister Eric Roozendaal was given a $10,000 discount on a Honda SUV from the Obeid family as a bribe.
ICAC found Moses to be corrupt when it released its findings into the investigation in July 2013.
When contacted, Obeid’s lawyer Abbas Soukie confirmed Moses was charged on February 8 and that he would “strenuously defend the charges that have been brought against him”.
The matter returns to court in May.
