Bear in mind, the last time the extended the waiver on 30 March, the day it was going to expire - it was on a Sunday. The current waiver expires tomorrow, so they would need to extend that or come up with some other funding source.
"Subsequently, the Company completed a waiver agreement with the Administrative Agent under the ABL Facility to defer the financial covenants test period from the twelve months to March 31, 2025 to the twelve months to May 31, 2025, and to waive the Review Event under the terms of the ABL Facility due to the downgrade of the Company’s credit ratings up to April 2025. Pursuant to the terms of this waiver agreement, the Company is required to cash collateralize the outstanding bank guarantees issued under the ABL Facility and the committed availability for revolving loans under the ABL Facility can be restricted at the Lenders’ discretion. In addition, pursuant to the terms of this waiver agreement, the Cash Balance Covenant is reduced by any amount held as cash collateral under the ABL Facility."
What's interesting is last time they got the waiver extended, they did not notify the market.
Now I don't think this is good practice - as I think it is definitely a significant matter. But given its record on this, if no waiver is granted, and no new funding source has been secured, then this stock gets suspended and does not trade on Monday (if it does, while in breach of its funding conditions with the waiver expired, they would have breached their duties). Alternatively, if the stock trades - we could get an announcement about the waiver, but if it just trades with no announcement... then we assume one has been given, given they neglected to tell the market last time?
