We have come full circle back to February 2008. Then Anglo,ARM,Genorah,NKWE and DMR reached an agreement whereby;
1. The rights would remain with Genorah. 2. The parties would negotiate a joint exploitation of the resources.
Why do we now come back to contesting the rights? Clearly it has to do with NKP possibility of doing the projects with Xstrata rather than Anglo/ARM.
A deal was reached in 2008 with the involvement of the DMR and we can expect something similar this time, but going further in that this time it will involve also the specifics for joint development.
These legal actions are Anglo's weapon against any deal with Xstrata. The DMR should also favour an Anglo deal if it helps to get them out of this difficult situation.
NKP is not dead, but the Xstrata JV may well be.
