Namibian Supreme Court Appeal
Metals Australia is delighted to inform the market that the Namibian Supreme Court has today
handed down its decision on the appeal by the Company against the judgment of the
Namibian High Court in relation to the claim by the vendor Malakia Amakutuwa for the return
of Metals Australias Exploration Prospecting Licences 3306 and 3308.
In a unanimous judgment, Justice ORegan (Justices Maritz and Chomba concurring)
reversed a previous High Court judgment of a single judge and decided in favour of Metals
Australia. Amakutuwa was also ordered to pay Metals legal costs in both courts.
The Supreme Court of Namibia is the highest Court of Appeal in Namibia, and there can be
no further appeal from their decision.
In a statement released today, Metals Chairman, Mr Sol Majteles said,
We are delighted that a final ruling has been made by Namibias highest court,
confirming the true state of affairs as has always been maintained by us. Metals
Australia is committed, through its subsidiary, Metals Namibia, to concerted
exploration activities, which we believe offers Namibia considerable development
potential, including job opportunities. These have been much delayed and
obstructed by the unsuccessful litigation. Metals Australia has been committed
from the outset to exercising its prospecting and other rights in a good faith
partnership with the people of Namibia. We welcome the opportunity now to do so.
