Scaling may be more advanced than 40nm. With the passage of time they may not have been physically working on 28nm but it is human nature with high achievers to run through things in their mind. When they resume working a lot of the work may have been thought through.
I am sure Coby mentioned that at 28nm they did not have to stack.
