I can see the point you are making with the march 09 example but I think you are breaking the rules with your fork and anchoring the fork on the body of the candle rather than the bottom of the tail to make it fit price action in hindsight. If you do the same with the current fork and anchor the fork on the body of the may 2010 candle rather than the bottom of the tail then I believe that the SP has already broken out. Happy to be proven wrong but in this case my trading account would prefer otherwise :-)
