the australian government says that espousing a view that legal justice should be excluded to an individual on the basis of their race is being spoken by a racist.

That Human Rights Commission definition is false. It might be the premise around which public policy related to racism should be formed, but it doesn't accurately define racism. Racism is ascribing inferiority or superiority on the basis of race.
