Why do you wilfully misrepresent the judgement of Perram J. in dismissing ASIC's responsible lending case against Westpac? Neither Perram, nor the full bench of the Federal Court (in dismissing ASIC's appeal) criticised the regulator for not seeking the maximum penalty. Perram knocked back the $35 million dollar penalty, jointly agreed to by ASIC and WBC, on the basis of law not on some notion that the penalty was insufficient. The full bench concurred. I suggest you read both judgements in their entirety and stop your nonsensical posts here and elsewhere on HC.
