Well its not unfounded as you've yet to respond to the invitation to supply evidence of Perram J's criticism of ASIC not seeking a higher or maximum penalty against WBC (2019, responsible lending laws). Despite your (no doubt) furious internet searches through the candle lit wee hours, it simply isn't there is it JC? For info here is a summary of the judgement: the Court dismissed ASIC’s case both on the facts and on the law. This meant that not only did ASIC fail to prove its case, the Court also rejected ASIC’s interpretation of the responsible lending requirements. Which again begs the question of why then would Perram J go on to opine ASIC should have sought a greater penalty. My criticism of you and your commentary stands. Have a good day. Cheers.
