Would also seem less likely than not to me because of the extra cost of litigation and the possibility of RMS costs being awarded and the fact that adjudication (which is independent) would've already occurred .
Like anything I imagine, if you think you have a strong case in law you roll the dice but if you are sensible you get legal opinion on that beforehand .
