You have said it yourself "constructive trust - no". The whole aim for CHM was to obtain some portion of the material asset (Jack Hills). This did not occur according to Mr Justice Jacobson's judgement. The rest of this matter in the scheme of things is really insignificant coming to this stage.
In racing parlance "times and margins please judge" as correct weight is declared. It's game over for CHM.
