Doesn't ISX's latest foray into court in late July have a claim that ASX does not have the power to instigate such a report? As such, I doubt you will see the report before the court makes a decision on that. I think a clean report would really help ISX. A report that is not clean would seem to go a long way to sinking damages claims against the ASX, but I am no expert in that so who knows.
I am yet to understand the strategy of the litigation, but I am interested to see what happens. It has broad implications for the whole market.
