If you suffer damages (financial loss) because there can be proven on the balance of probabilities that legal obligations have not been fulfilled, then I presume you can seek remedy against them shown to have breached the law as to their responsibilities. I would wait and see what comes out regarding any possible class action. It was mentioned prior to my post, perhaps someone else knows who is starting it.
