Yes the " FARM" is a separate JV company in its rights does bring some questions. Title would be in same names as the JV operations and production agreements were. WHARF would still be listed as in the JV ( being fully paid for them before the standoff began ).
WHARF still own legally 10% of the land where the plant sits on. I still think WHARF paid some of the early cash calls before construction, even during the Momentum design stage.
Land valuations with/without the plant on it, whats WHARF entitled to.???
I still want to know if WHARF have been allowed to see the tender documents etc relating to the dispute. Doesn't discovery in the legal terms allow them access to them if granted.??? Can they be given on terms or conditions attached if granted.????
Honestly, I would expect the new board to update the SHERs as to where the litigation is at and how it affects them and are they still standing by the original terms of reference and for what reasons. This is something that has not been addressed since the WRIT was issued.
We know they read HC and its time this was answered.
