I just wonder in latter submissions FAR decided to have a bob each way instead of all their bets on Declaratory relief?
Who knows just guessing, as is everyone who thinks there is a deal with WPL if FAR awarded DC.
Personally I don't believe there has been any deal.
The "pressure" on FAR says there is no deal?

If ICC orders WPL to give the asset back to COP, can't see that the ICC would or could order COP to give WPL more than what they received?
As said, COP didn't ask or have anything to do with the asset from that point?
WPL chose to close the sale knowing it to be in dispute.
COP would the transfer asset to FAR for sale price plus COP's adjustments.
WPL's adjustments be matter of dispute between COP and WPL.
Again we are all guessing. Just a talking point.

Looking back it was a very confident move for WPL to agree to close the sale knowing it to be in dispute?
I guess their legal advice said go ahead, and in any case, probably thought FAR could never go the distance?
Guess we are going to find out if they were right soon?
