    imo this thread is missing the point. chm can not afford to settle. chm has to pay over half of any settlement to the litigation funder and then pay out everyone that has kept them afloat and then whatever is left has to be divided by over a billion shares. even a 'generous offer' from mmx couldn't be accepted. it just wouldn't be enough and chm has nothing else. settling the evans and koh claim makes mmx look good in the eyes of the court. you can bet they are also making very reasonable settlement offers for the main case right now, safe in the knowledge that chm can't afford to accept. when it does go to court this all has major advantages for mmx and the outcome of the trial. litigation can always go either way despite the apparent merrits of the case. this will go to court in september and the judge may hand down a decision toward the end of the year and then there will definitely be appeals well into 2010. i dont think chm is a big issue for mmx share price because the die is already cast - mmx just have to get on with business like they are.
