Hackett, the general rule is costs follow the event, that's the case in all civil proceedings. Yes if SMM loses they are up for legal costs, but also conversely if AVQ loses they are up for legal costs - regardless of who initiated the matter.
The "costs follow the event" rule was even quoted in Deet's post.
