There is no grey area here. Just because there is a plan to continue to the next phase, doesn’t mean it will happen 100% of the time. All parties need to assess the Dev phase, and then assess if they want to continue the partnership. If all parties agree to continue the partnership, they will sign the Commercial agreement. This has not happened yet, therefore the new commercial agreement is not yet in place.
