I think there are three tests, any one of which is now sufficient whereas before 1995 all three had to be satisfied;
a)Genetic or claimed genetic descent. This test has been made non determinative by DNA testing being unpalatable, dismissal as eugenics and the arguments of Justice Merkel in 1998 re adoption. b)community acceptance by recognised 'leaders' who can then issue certificates such as Certificate of Aboriginality' to genetic whites such as your Yugoslav example. c)Self Identification alone as stated by Justice Drummond.
