I had never realised Crossland was Winterfall
So MMX took over Winterfall with iron assets in it.
On a side issue any arguement that the royalty is part of the purchase price would go out the door as they took over a company with an existing obligation to pay. This is factored into what you are prepared to pay for it.
No wonder CHM sought leave to amend claim after comments from former Winterfall officer about knowing CHM money was used.
MMX now have the dual issue of Winterfall having knowledge and co defendents having shares in Winterfall and gaining benefit.
