    Hello Nasty1

Yes I have a had a bit to do with courts and cases. Some good, some bad experiences.

In relation to the statement "anyone can lodge a SOC..." the claim is lodged by lawyers and even though I am sure there will be howls of "they will do anything for the fees" my understanding is that a case has to be constructed that has foundation or else there is implications for AH themselves for lodging a baseless claim.

Having said that it always amazes me in commercial litegation that you can have two sets of legal advisors obviously with two totally different opinions of who is right and wrong.

As to the people running CHM are you refering to the board
or some of the behind the scenes larger holders. I think any of their sins will seem insignificant compared to the group that gave birth to MMX/CHM and are now MMX co-defendents if the SOC is proved.

The quality of your current board cannot remove the taint of been sporned out of the CHM/Nicu/Barnes/Grimaldi/Roberts camp. Unfortunately for the current board they are relying on the paper trail of these co-defendents and what they actually got up to.

I would love to know what reason MMX provided in their defence as to how a bunch of CHM shares turned up in their hands to allow them to sell and raise cash to help pay for assets.

The claim or fact the two seperate claims were first raised by Koh/Evans and I think it has taken new blood in CHM to pull case togther and to begin to run professionally and gain traction. The second claim now managed by CHM relates to original fund raising activities and has yet to even crank up now that it is in AH hands.

We have seen many "gods of commerce" now turned upon and and cast now as demons so who is behind CHM I see as having no relevence on outcome. I am a believer in AH but I am also biased as I am a holder of CHM not MMX.

    As to others comments

    - injunctions - are you sure that CHM is not in the current proceedings pursuing this and this is due to be heard in May hearing.

Mitsubishi payments - are people seriously believing that Mitsubishi will write a $1 billion cheque out and hand it over to MMX with court case hanging over them. If you paid a deposit on buying 50% of an asset and then a court case was started that cast even a small element of doubt over ownership would you keep paying.

I think they would have put MMX on notice regarding payment to date and be telling them behind the scenes to get it sorted out. At best the funds will go into a trust account pending this case.

I think institutions have factored in a chance of requirement for settlement into current MMX share price. Looking at comparison charts something is holding MMX SP back compared to other iron ore plays.

But as I said before I am biased. I also hope the reference about soap boxes is not saying that posters only want to read things in line with their own agendas as that would be rather boring.
