If CXY broke pollution guidelines set in advance of approval and then failed to meet these standards, then I can accept a closure order.

However, if they were not informed of data collection and monitoring standards prior to investing millions of dollar but the absence of these were used to revoke regulatory approval, after the fact, surely they have a case for some form of compensation? If millions have been squandered due to inadequate regulatory guidance, surely the regulatory agency has some questions to answer.

Any lawyers out there know the answer to whether regulators are subject to liability for incompetence (assuming there was some)?

As for not be able to prove or disprove an explosion, why not just say that we cannot prove or disprove that ancient fairies of Narnia have been disturbed by the coal gasification process. The time for the regulators refusing to accept the possibility of unknown unknowns was prior to giving CXY the go ahead, surely.
