If I were Frank, I would be pragmatic and try to sign a deal to limit any exposure I had to everything that has gone on for the last 2 years, while trying to capitalize on anything that might happen in the next 2. This would probably mean handing over the rights to the tech and agreeing to be a none active investor, even a lock up if there is a legal way to do that in return for legal immunity, and keeping what I had already got. I would sleep better if I had an arrangement like that. Of course, this would require a similar agreement from the other 2 to work. Frank would then be able to capitalize just as any other shareholder if PT gets traction and sorts this thing out.
