If you read the Bidder’s Statement carefully, it seems to me that there might be a loophole in the Board’s recommendation.

….they (the board) intend to accept the offer - is this formulation a binding contract for an obligating acceptance?
Is it possible, that they do not really intend to accept? If so do they have the obligation to tell anybody (resp. WNI) beforehand?

Another question:
… to any Brockman Shares they own or control – meaning their whole family? Do they really control shares of their wifes or children?

And: 13.9 Conditions of the Offer (a), (d) –not fulfilled? I have seen no corresponding publication/ASX-announcement !
