I'm not sure theft counts as a capital loss.
Seriously though, my understanding is that X number of shares have taken from me and given to somebody else at $0.00 per share. Should therefore be a 100% loss on each of those shares. Very simple way of looking at it but I'd be interested to hear what your accountant says.
