The court case should have no impact on ASX investigation process. If the final draft findings report is ready it should be disclosed . If ISX do what is needed to be in compliance or are in compliance they will be trading .
Court case is running in tandem.
ASIC are the only ones who can prosecute.
    ASX can delist if required.
The fact we have sent reply to the draft findings on the 24th January. I believe ASX were ready to release final findings prior to 7th Feb .
I think we will definitely get to see the final report this coming week and I feel it will be underwhelming for those who are expecting fireworks.
We are very close to a deal both sides finalizing the findings where both sides are happy.
IMO the court case is just an insurance policy , that won’t be material.
ASX will 100% not file a defense , case will be dropped before that milestone. There is no way they will want to defend against the SOC.
It will be much more beneficial to release a fairly benign findings report that doesn’t require answering the allegations from ISX.
If the findings aren’t released and case dropped by the 28th Feb , I will be extremely surprised.
