"the tenement was forfieted thru negligence"....no it wasn`t. If a mining tenement is forfieted thru negligence it implies the holder has not complied with the mining act and has the tenement taken from them by the DOIR.This is not so in this case. E46/209 was granted on the 27/8/89 and ran its full course and EXPIRED on the 26/8/2005. Once a tenement expires it reverts to the crown and becomes vacant crown land and is available for any person with a current miners right to peg. It remained vacant for 3 days. CAZ pegged it on the 29/8/2005 and has acted within the requirements of the mining act.
