I'm surprised that CFU have not jumped on Nuon for breach of contract XOC, why haven't they? Possibly because Nuon have not breached their contract.
The product development occurs through a number of stages, and at the completion of each stage there is a period of review, or a hold point, where CFU and other parties sit around and have a chat about how things are going, and at this point there would likely be an opportunity for each party to discontinue, even if all technical requirements were being achieved - and even if there was no such contractural clause you might be aware that the majority of contracts are not worth the paper they are written on (and some I receive from clients are shockers).
Time to move on from Nuon and look forward to erm... whatever's going to happen next.
