Technically, you may be correct until the company actually clearly states what the position is. But when your real estate agent rings you and says that your buyer is pulling out because they found termites under their building inspection clause, you also technically still have a contract in place until it's officially cancelled, even though it's unenforceable and you'll never see your money until you get a new buyer.
