    The way it works, in Australia at least, is that proceedings can be filed at any time. The Defendant only becomes aware of the proceeding once it has been served with the originating motion.

    Just because the originating motion has been filed, that doesn't mean the Defendant (GDN) is aware of the proceeding or has anything to answer. Like I said, that only comes once they are served. The Complainant/Plaintiff may file an originating motion and never serve it, letting it expire.

    If the process filed on 23 May, then it is likely that it wouldn't have been served yet, especially if it was being served by registered post (as is done on companies in Australia).
