Thats rights. If Mr Jones has 100,000 GWR shares and accepts the offer. He now has 700,000 FAS shares. There is nothing stopping him from then buying GWR shares, on market. The only way this would need to be disclosed if the holder of GWR shares bought enough to become a substancial holder or it was FAS buying GWR and FAS increased their holding by 1%.
