The legislation in WA and other states seperates the carbon in trees from the land and the forest and at times the forest products. All three can be sold independant of the other. To enter into a forest rights agreement or carbon rights all parties with a vested interest in the land must give their consent. The carbon right is then written onto the title in the name of the owner of the carbon right who may or may not own the land or trees. It is often the case each compoinenet of the forest is owned by different parties. A simple title search of the block in question will determine if the carbon rights are owned by the managment company, the land owner or the forest owner. Once the owner of the carbon and forest rights is determined you then have to determine if those carbon rights have been on sold or if there is any liability attached to the forest through the past creation of carbon credits.
