Avera do not operate on spot market prices. No investment of this size would have had an ROI calculated on a spot price, let alone a spot price that the whole world knew was being pushed up by hedge fund speculation.
BHP use $40; I would imagine Avera would use anywhere between $40 and their long term contract price at the time.
