What were you expecting the defence to say??
'does not admit XYZ...'
'denies ABC...'
'and further says DEF...'
Just like I've said before, just because VMC has put something in their statement of claim does not mean that a judge will make a finding of fact in their favour where that fact is contested, neither does it mean that a judge will determine the legal issue(s) in their favour after resolving the factual issues. Same goes for the SPX defence. What is required is to see the evidence that either party actually has to (a) prove the statements made in their respective pleadings; and (b) to disprove any statements made in the other parties' pleadings.
So it's still a wait and see for me on both VMC and SPX until this further progresses.
