I'm sure the industry can legislate to prevent shorting if it really wanted to or was forced to do so. The practice has more negatives than positives as far as the average investor is concerned. As for the 'lending' aspect being like any other commodity, many hedge/super funds use their own 'investors' funds to sub-lend to shorters without the knowledge or permission of their own clients. At any point in time, its as if a share can have multiple legal claimants yet voting rights are hived off and only remain with the lenders themselves.
But I am intrigued why there are no bids coming along for PLS while LTR and others seem to be fighting off predators?
