Whilst you were basing your argument on the situation within Australia, what happens if you extend it to the nations of the world. Perhaps each different environment around world gives those living there a different perspective and different priorities. I'm sure most would claim they have a deeper understanding of their own society than those looking over the fence.
Whilst you are focusing on the rights of a single individual, ordered society can only exist if the rights of the majority take precedence over the rights on the individual. There is always going to be some price paid by someone depending on the type of society you have. No system is perfect so each society has to decide if it is going to err on the side of those who respect the laws or those who transgress. Either way there are always going to be victims, so it becomes a numbers game. Which way is going to produce the least victims? Singapore may have it right.
Stop looking for a system that gets it right 100% of the time, look for something achievable. Anyone that gets it 51% right or better is erring on the right side.
