Just to clarify. The reason I said, patent applications are not proper references is because BD might be just trying their luck, by lodging one. I'm not saying their patent will be denied, but unless one is a real expert in the area and compares our patents with their application, its hard to judge their chances of success. I am not expert in visual technologies, but I do know that the university people who helped develop our technology are. LBT looked all around the world to find their expertise and were surprised to discover they were just down the road. Its hard to imagine our patents are so worthless than someone else can just replicate what we're doing. I also think the board aren't so dumb to invest their own money in technology that will soon be subject to direct competition.
However, I also should stress that because I'm not an expert, I am not saying we will have an absolute monopoly because of our patents.
