There are other issues like the voluntary assumption of risk or breaking the rules (gaining entry is not the same as not being physically forced not to enter).
If you go back to work to get your phone after hours or do more work, you have implied permission. You do not have implied permission to go back to the place of work drunk, especially for the Minister of Defence. You might have a nice boss who turns a blind eye but if they never give consent, express or not, if it goes tits up, you're the bad guy.
Telling people they don't understand "duty of care" and shouldn't drive a car because of your absurd understanding of it is really beyond cringe, it is unfathomable.
