Many of the decisions by un-elected people are made as political rather than legal ones.
People who make these political decisions should have to explain their reasons when it is not in their purview to make political decisions
So the old idea of a separation of powers is a total farce, but the Federal government allows them to get away with it
I only had a minimal legal training but I have always failed to see how they could legally use Marbo as the key for widespread application of the same ruling throughout Australia when the reason for the decision on Marbo has never been repeated on the mainland
I have no complaints for the original Marbo decision, not one that I would have chosen but a sound judgement anyway
