    "How is an assault defined in the law?"


    "A useful starting off point in identifying how an assault is defined by the various criminal codes is Queensland’s definition. The Criminal Code in s 245 defines assault as the following:"




    "(1) A person who strikes, touches, or moves, or otherwise applies force of any kind to, the person of another, either directly or indirectly, without the other person's consent, or with the other person's consent if the consent is obtained by fraud,





    or who by any bodily act or gesture attempts or threatens to apply force of any kind to the person of another without the other person's consent,






    under such circumstances that the person making the attempt or threat has actually or apparently a present ability to effect the person's purpose,





    is said to assault that other person, and the act is called an assault"

    "I saw Abbott raise his elbow above his head and his fist was clenched and then he drove his fist down. I did not see a punch land. As I pushed along the corridor, I saw Barbara being helped up very ashen-faced."





    Based on the Australian Law definition of Assault, it sounds like an assault case to me, and if I was the victim i would be taking it a lot further.
