All the consignments were shipped from Freemental to SA from 2005 through to May 2006.
However, the earlier shipments were for CMQ's own stock. Most readers (if not all)including myself automatically associated DW's Dec statement of shipping to SA with the Inviro's order.
But the court document at the following paragraphs revealed :
95: Dr Grimbeek did not answer that question until 15 March when he sent a status report on Chemeq sales to Mr Geldart (exhibit 1/650 - 651).
98: Accordingly, Chemeq arranged for the product to be shipped to South Africa and for Inviro to be invoiced.
104: Chemeq maintained its own stock of product at the UTi warehouse. However, the consignment of 2000 units for Inviro was not part of Chemeq's inventory.
So technically, the 2005 Teflon is correct as it did not state who it was for. With hindsight and the court information, it proved how devious and deceptive the Teflon executives were - hatching sale contracts to mislead shareholders/bondholders as to the satisfaction of the 2005 confirmed sale covenant, telling shareholders the price achieved were as previously indicated when CMQ were plotting to give 1 unit away for every 2 units; stating the sale were not financed by CMQ while Dr Grimbeek was supposed to pay 60 days after he on sells the stuff.
Yes, someone ought to go to jail for the lies and deceptions.
